Ashram Terms
IMPORTANT INFORMATION. PLEASE READ THOROUGHLY.
These terms and conditions pertain to all The Ashram Program(s), including The Ashram Alchemists, The Ashram Masters, and any other custom iterations.
Kisma Productions LLC and its staff offer wellness, spiritual, personal and professional development, and educational services. The program sessions provide training for yourself and are not medical, financial, legal, or counseling advice.
You acknowledge that Kisma Productions LLC does not guarantee your ability to achieve a specific outcome from programs and trainings, the one-on-one coaching sessions, classes, or events. Each person has different awareness, skills, and work ethic, and your level of participation along with factors outside the control of Kisma Productions and its staff will impact your level of success from this program.
Defaults and Cancellation Policy: 72 Hour Cancellation: You may cancel this transaction without penalty or obligation by contacting Kisma Productions prior to midnight of the third business day after the date of this Agreement. (Note: Refunds may take approximately 4-6 weeks to post to your account.)
All charges associated with this order will appear on your bill under the name: Kisma Productions, LLC.
NOTE: If breakdown of communication between the client and Kisma Productions, LLC occurs, or both are mutually agreeable that the coaching relationship is no longer is beneficial, this agreement may be amended after 7 months and the client will not be obligated for future payments.
Termination: Kisma Productions reserves the right to cancel anyone out of the program for any reason it deems appropriate, such as if determined that your behavior is damaging to clients, Kisma Productions as a company, team members, or program's reputation, or to other participants. In such cases, there will be no refund.
General Provisions: A. Warranties. You acknowledge that you are not relying upon any warranties, promises, guarantees or representations made by anyone or us acting or claiming to act on behalf of us unless it is in writing and made a part of this Privacy and Your Account: Please review our Privacy Policy (KismaAwake.com), which also governs your visit to the Website, to understand our privacy practices. We do not sell products to children. If you are under 18, you may use the Website only with the involvement of a parent or guardian. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
Indemnification: You agree to indemnify and hold harmless _Kisma Productions, LLC. as a result of your voluntary choice to participate in this program. You will not hold Kisma Productions, LLC or its representatives responsible for any actions or adverse results created as a direct result of advice or recommendations given by Kisma Productions, its Coaches, or other program participants.
Disputes: Any and all unresolved disputes regarding this Agreement shall be settled by binding arbitration before a single arbitrator, using the Commercial Rules of the American Arbitration Association, California. The laws of the State of California shall govern this Agreement. If it becomes necessary to enforce this Agreement through legal action, then we shall be entitled to recover reasonable attorney fees and costs incurred in such enforcement of this Agreement.
By checking the "terms and conditions" box, you irrevocably agree that, if Kisma Productions, (the "Company" or "we/us") approves your application and accepts you as an Ashram Alchemist or Ashram Master (the "Program") participant, then this Package Agreement (the "Agreement") automatically becomes a binding contract between you and the Company, and applies to your participation in the Program.
By checking the "terms and conditions" box, you are acknowledging that you have read, agree to and accept all of the terms and conditions contained in this Agreement. We may amend this Agreement at any time by sending you a revised version at the address you provided above.
By completing the Application and checking the "terms and conditions" box, you authorize the Company to charge your credit or debit card, or cash your check, as indicated above, as payment for your membership in the Program, if the Company approves your Application and accepts you into the Program.
To further clarify, no refunds will be issued and all payments must be paid on a timely basis. If a payment becomes more than 30 days late, the entire balance becomes due and payable immediately at day 31.
We are committed to providing all Program participants with a positive Program experience. By checking the "terms and conditions" box, you agree that the Company may, at its sole discretion, terminate this agreement, and limit, suspend, or terminate your participation in the Program without refund or forgiveness of remaining payments if you become disruptive or difficult to work with, if you fail to follow the Program guidelines, or if you impair the participation of Program instructors or participants in the Program.
We respect your privacy and must insist that you respect the privacy of fellow Program participants. By checking the "terms and conditions" box, you agree not to violate the publicity or privacy rights of any Program participant.
We respect your confidential and proprietary information ideas, plans and trade secrets (collectively, "Confidential Information") and must insist that you respect the same rights of fellow Program participants and of the Company. By checking the "terms and conditions" box, you agree (1) not to infringe any Program participants or the Company's copyright, patent, trademark, trade secret or other intellectual property rights, (2) that any Confidential Information shared by Program participants or any representative of the Company is confidential and Proprietary, and belongs solely and exclusively to the Participant who discloses it or the Company, (3) you agree not to disclose such information to any other person or use it in any manner other than in discussion with other Program participants during Program sessions.
By checking the "terms and conditions" box, you further agree that (4) all materials and information provided to you by the Company are its confidential and proprietary intellectual property belong solely and exclusively to the Company, and may only be used by you as authorized by the Company, and (5) the reproduction, distribution and sale of these materials by anyone but the Company is strictly prohibited. Further, by checking the "terms and conditions" box, you agree that, if you violate, or display any likelihood of violating, any of your agreements contained in this paragraph the Company and/or the other Program participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.
We have made every effort to accurately represent the program and its potential. Claims of actual earnings can be verified and examples of actual results can be provided, upon request. The testimonials and examples used are not intended to represent or guarantee that anyone will achieve the same or similar results. Each individual's success depends on many factors, including his or her background, dedication, desire, and motivation. By checking the "terms and conditions" box, you acknowledge that as with any business endeavor, there is an inherent risk of loss of capital and there is no guarantee that you will earn any money as a result of your Participation in the program.
By checking the "terms and conditions" box, you also acknowledge that you have represented to the Company that payment of your Program membership fees will not place a significant financial burden on you or your family.
